meprasad4u Posted November 7, 2016 Report Posted November 7, 2016 I stayed in US from L1-B Visa from Sept 2010 to April 2014. My employer filed fresh H1-B for me in same year 2014 CAP and it got approved with petition start of 1 Oct 2014. Then I traveled back to US in May 2015. (i.e after staying in India for more than 1 year). I learnt that, in this case i wont be able to utilize full 6 years of my H1-B , since my L1-B stay period will be also be considered and my Max out date will be in Nov 2017. (To reset the counter, new H1-B should have been filed after staying in India for one year)But couple of months back, when I recently switched my Job, i got my H1-B transfer approval with end of April 2019. So does this mean my 6 year counter is reset and I can use full 6 years of my H1-B? Please help.

My USA entry and exit details are - Entry Date Exit Date VISA Type 4 April 2012 30 June 2014 L1B 1 May 2016 H1B My current H1B was filed on 02 Apr 2014 quota when I was in US on L1B. please let me know whether my L1B stay of 2 yearsand 2 months will be included in my H1B max out of 6 years or not.
