Kiran0009 Posted November 4, 2016 Report Posted November 4, 2016 Hi, I have a valid I-140 with employer 'A'. My spouse got H4 EAD valid till my H1 expiry date(2017 November). I'm planning to move to a different employer 'B'. He might file my new labor after 6 months of joining date. If I don't get my new Labor or I-140 with employer 'B' by Nov 2017, meanwhile my spouse needs to file her H4 EAD extension. So, my question is can she go for H4 EAD extension with my previous employer('A') approved I-140 and my copy of H1 with employer 'B'. Appreciate your help. Thanks, Kiran

Attorney_15 Posted November 23, 2016 Report Posted November 23, 2016 A prior employer's I-140 can be used for extensions of status and even for an EAD Card, assuming the priority date on that I-140 is not current so long as the I-140 has not been revoked by the employer.
