srivi51 Posted November 3, 2016 Report Posted November 3, 2016 Hello friends, - I have stamping until Aug 2017 with my old employer - Got a new passport in Jun 2016 - H1 transfer started in Jun 2016 - still in progress - I-140 approved in Oct 2016 - Making H1 transfer premium now(Nov 04 2016) 1. Can I go to India (Around Nov 20 2016)When my H1 transfer is in progress. 2. If I go to India now, Should I go for VISA stamping ?
shekar11# Posted November 4, 2016 Report Posted November 4, 2016 You can use your old employer's visa. No issues. But make sure you have your employer B approved I-797 petition.
rohit369 Posted November 4, 2016 Report Posted November 4, 2016 I suggest you wait for 1-2 weeks and travel after the transfer decision with the new H1 petition. You will not require a fresh visa stamp since your H1 visa is valid till Aug 2017.
