Rajeshw61 Posted November 2, 2016 Report Posted November 2, 2016 Hi, I had attended visa interview in 2015 June and i traveled in July 2015 for some reasons i resigned the job and came back to india in November 2015. now i am working in india and my employer says they will transfer my visa and as they have upcoming project. my question is since its almost an year since i traveled do i need paystubs?, i did not bother to take the paystubs from them and the email id was terminated.
pontevecchio Posted November 2, 2016 Report Posted November 2, 2016 Paystubs are irrelevant in this case.
Rajeshw61 Posted November 2, 2016 Author Report Posted November 2, 2016 Thanks for the answer !! i dont even have W2 as my employer was not in contact to ask him. does this matter too?
pontevecchio Posted November 3, 2016 Report Posted November 3, 2016 No. Firstly "transfer" is usually applied to a situation of changing jobs in the USA in H1 status. THAT needs a H1 petition approval and stubs for proof of previous valid H1 status. In your case the company will file a H1 non cap petition for you and on approval you will need a visa and can then come over. you do not have H1 status now and hence no stubs are needed.
rohit369 Posted November 4, 2016 Report Posted November 4, 2016 No paystubs required. I have done this with my previous employer.
Rajeshw61 Posted November 6, 2016 Author Report Posted November 6, 2016 Thanks for the Both! Rohit can you explain more?. after how much gap have you applied?
