asharat Posted October 31, 2016 Report Posted October 31, 2016 Hi all, While my H1B processing is in 221(g), Can I go on B1/B2 Visa to settle things to vacate house, close financial accounts, sell stuff? How this will impact my current H1B visa processing stuck in 221(g)? Will I lose H1B status once I trave in B1/B2 Visa? Thanks,
sairam5027 Posted October 31, 2016 Report Posted October 31, 2016 Hi, i was in similar situation in 2010. My h1b was under 221g Blue and my passport was with Delhi Embassy for 4 months. Once i got my passport i applied for B1/B2 and went to kolkatta consulate mentioning the same reason. I had proofs as well like apartment lease, car documents etc. But they denied my B1/B2 visa and stated the reason that once you go there, you will file for H1 transfer with a new firm and this will defeat the purpose of having a pending 221g with the Delhi consulate. So i tried new h1 petition with a different company which was very tough in 2010. I am sorry to hear your situation, But i hope you can find a solution quick. Again that was just my situation, may be it could be different in your situation. Good Luck

Thanks, You could move to another employer .and get ur h1 transfered and try new h1 . If you are in EVC Model . Move to Vendor

If you are in EVC Model . Move to Vendor As I consumed 5 years in L1, when I filed H1 I have only 1yr left. My I-140 is approved within this 1 yr H1 span. If I move to another employer will I get 3 yrs on H1 or not? If I don't get I will not have sufficient time to file GC with new employer. Thanks

Thanks Once you have an approved I-140 you will get a 3 year extension with any employer.
