damning15 Posted October 30, 2016 Report Posted October 30, 2016 I had a H1B visa that was filed in 2006 and was subsequently stamped in 2007. I travelled twice on it to USA in 2007 & 2008. During the 2008 trip, the petition was extended upto June 2011. After 2008 I hadn't got an opportunity to travel on that visa. Gradually I left that organisation(say A). Though my petition was expired in June 2011, I got to know that it can be applied for out of cap extension(to use the unused duration), if there's a sponsor. As the petition and other relevant documents were with me, another organisation(say B) volunteered to transfer my visa. Accordingly, petition transfer and extension was filed and approved under premium processing. I attended the interview at Chennai, where I was handed over 221G blue slip. It requested multiple documents from organisation B as below: Detailed description of project I'd be part of. Copies of past 2 years' federal tax returns State Unemployment Wage Reports for past 3 quarters as filed in all states Notarized list of all employees. It's been 3 months since I received this slip. However, the organisation B is deferring their reply. Despite repeated follow-ups organisation B replied that it would like to utilise the time given by the consulate(1 year) to provide complete information, which has made me started lose confidence in it. I hold petition and other relevant documents with me, as I had taken them to the visa interview. Thus, in this current state of things, can I try with another organisation(say C) with the renewed petition and move further?

pontevecchio Posted November 1, 2016 Report Posted November 1, 2016 Dear damning15, B is a fraud. Find out if A will file a H1 petition for you since you worked for them before. You are entitled to 6 years minus existing H1 status time here.
