SRRA Posted October 29, 2016 Report Posted October 29, 2016 Hello, I am in my 8th year H1B visa extension with approved I-140. Recently couple of weeks back, I lost my Client Contract but my Employer is paying me my Salary and I am looking for another client contract. However I am getting mostly offers with condition that I work full time employee. If offered can I accept a full-time job on on 8th year extension with a new company even tough my I-140 and H1B is held by my current employer? I have couple of interviews lined up, based on your replies I will have to explain and persuade the interviewing companies for new job/contract.
pontevecchio Posted October 30, 2016 Report Posted October 30, 2016 You can potentially get a new 3 year H1 extension with a new employer as long as the I-140 is approved. Subsequent revocation does not affect the three years. But any new employer will have to start from scratch though you get to retain the PD generally. Talk to a lawyer to get specific responses to your unique situation.
