Change from Employee To Contractor- Same Employer

Hi!

I have H1B approved by a municipal govt employer and I am currently a fulltime employee. As an employee, my salary cannot exceed more than a certain threshold. Advanced technical positions are classified as 'contractor', which allows the employer to pay them higher salary. A highly technical position currently occupied by a contractor is opening up and the employer wants me to take the position because my skills are suitable.

Question: Employer wants to change my classification from employee to contractor. Will my H1B, which I got as employee, be affected?

On H1, you can NEVER be a contractor.

The H1 is for employees only.
