orbit123 Posted October 28, 2016 Report Posted October 28, 2016 Hi All , I got an RFE for Filing from Programmer Analyst to HR Manager through a new employer , I handed over to the attorney and it seems they have to do a educational evaluation and said my Univ is not Accredited and they are skeptical about the approval . I wanted to know what are my Options if the RFE is not approved . Do i need to go back to my country ?/ Pls advice . Thanks P
JoeF Posted October 28, 2016 Report Posted October 28, 2016 If the university is not accredited the "degree" can not be used for anything. If you used the degree for the H1, that's a sure denial. Why in the world did you sign up with a fake, unaccredited institution??? Care to tell us the name of the institution? You will have to go back to your home country.
orbit123 Posted October 30, 2016 Author Report Posted October 30, 2016 Hi , The university is accredited in 2012 and i got graduated in 2011 ,. I got my H1 approval with the same Univ . This is my H1 Ext . What are my options , can i do a MTR appeal and file a new petition. Thanks , P
JoeF Posted October 31, 2016 Report Posted October 31, 2016 If they got accredited after you graduated is completely irrelevant. The accreditation status at the time of your graduation matters. It looks as if the earlier H1 approval was in error. Filing an MTR or appeal won't help, because the "degree" can not be used at all. Get a real degree from a real university, and then you can get an H1 again.
