vanank Posted October 27, 2016 Report Posted October 27, 2016 I have applied for H1 in 2015 , denied in 2016. Have done MTR in 2016 and got denied. If i have apply for H1 in 2017 will my application will be picked directly as an exception case. Or my application need to go through lottery process as others. Please let me know.

Only exception case is applicable when you have any valid old petition even if you have expired visa stamping also. No exceptions and exclusions for H1B visa. Vasuki Venugopal Posted November 3, 2016 Report Posted November 3, 2016 Hello Reddi, I have valid old petition and un stamped from Employer A. Currently am working for Employer B. Shall i use my Old petition for Cap exemption? Since it was not stamped, is it eligible for Cap Exempt?
