vidhyashenbaga Posted October 26, 2016 Report Posted October 26, 2016 Hello, I am a H4 visa holder dependent on my husband's H1-B. My visa expired on Aug 2016. I applied for the extension and got approved. I hold valid visa till 2018. My husband changed his employer a month back. So we applied for the status change on our visa. The case got approved for both of us till 2019. My husband got his approved hard copy and mine is yet to receive. Meanwhile since we changed to new address my newly approved document returned back to USCIS. So I placed in a request to send back the approved file to my new address. Now I am in an emergency to travel India ASAP. My question is, can I travel with my expired visa in the passport. Since my visa got approved(till 2019) and i am waiting for the file to be received, will there be any problem in gong to India (with out approved file copy) ? Please let me know your suggestions since my travel is emergency. Thanks in advance.
pontevecchio Posted October 26, 2016 Report Posted October 26, 2016 Please do not confuse visa with status. You need a visa stamp in your passport and your spouses H1 petition approval to come back.
