My lawyer says its needed and we wil get RFE and she has seen it before , but my employer is not ready to share that copy with me. What do i do ? is ETA9089 absolutely mandatory with Eb2 i485 filing ? i have I140 and Labor approved copies . but just not ETA9089 copies. Link to comment
pontevecchio Posted October 25, 2016 Report Share Posted October 25, 2016 To the best of my knowledge you should not need that as the USCIS approved your PERM and your I-140. You may like to get a second opinion about it. If you look at the list of documents needed for AOS ETA9089 is not one of them. Link to comment

Attorney_15 Posted October 28, 2016 Report Share Posted October 28, 2016 An I-485 application requires a letter from the I-140 petitioner confirming the continuing job offer. USCIS does not include the ETA 9089 as initial evidence that must be submitted withe I-485. Link to comment
