Kamaljit Posted October 21, 2016 Report Posted October 21, 2016 Hi We applied for 485 AOS last year when priority dates went to 2011 for EB2 I. Since the dates moved back to older than our priority date and lead to AOS denial. Our H1 and H4 status is valid. However my daughter who is on valid H4 is in college and would be 21 in a year's time. She would like to apply for F1 so that she can complete her education. However I-539 has a question if AOS was ever applied. Can this potentially lead to COS denial ?
shekar11# Posted October 24, 2016 Report Posted October 24, 2016 You should be good as there is a valid reason.
JoeF Posted October 25, 2016 Report Posted October 25, 2016 Hmm, PD retrogression doesn't result in a denial of an I-485, assuming the I-485 was filed when the PD was current. The I-485s can just not be approved as long as the PD isn't current. So, your narrative doesn't make sense.
GNH Posted October 25, 2016 Report Posted October 25, 2016 It could . You may need to take help of an attorney for explanation along with the CoS request.
