chandrach Posted October 19, 2016 Report Posted October 19, 2016 Under 4 year 1 day rule, can I apply in 90 days early filling period for citizenship? I got LPR on 02.16.2012 but I went to India with re-entry permit for first time 150 days and then second time 378 days to finish my study. Since 08/23/2013, I have been in USA until now except for one trip to India for 5 weeks and another trip for 3 weeks. Therefore, under 4 year’s one 1-day rule, I would be eligible for filing citizenship in 08.24.2017. So my question is would I be eligible on 05.24.2017 to apply with 90 days early filling? or have to wait until completion of 4 years 1 day? (08/24/2017). Please clarify and advice. Thanks, Chandra.
JoeF Posted October 19, 2016 Report Posted October 19, 2016 No, when using the 4 year and 1 day rule, the 90 day earlier rule does not apply. If you file even one day before the 4 years and 1 day are over, the application will be denied.
