Vasuki Venugopal Posted October 19, 2016 Report Posted October 19, 2016 Hello Sir/Madam, I got H1B approved petition from my previous Employer and it has mentioned the valid dates from 1st Oct 2015 to 31st Dec 2016 and not stamped yet. Due to some reasons I have moved out of Employer A. Petition is still not expired and Valid. Is it possible that my new Employer can file a H1B Cab Exempt after Dec 2016 (After H1B Petition Expired)?
JoeF Posted October 19, 2016 Report Posted October 19, 2016 Sure, if you haven't used up the 6 years, a new employer can file a cap-exempt H1 at any time.
Vasuki Venugopal Posted October 21, 2016 Author Report Posted October 21, 2016 Thanks JoeF for your reply. I have one more Question Please assist me. Right now my H1B Petition status is approved, If my Previous Employer A withdraw my petition in future then would my current employer B file a Cap Exempt with old petition number (means withdrawan Petition)
LuckyLoser Posted November 1, 2016 Report Posted November 1, 2016 Vasuki . Have you ever worked with that petition ?
Vasuki Venugopal Posted November 3, 2016 Author Report Posted November 3, 2016 Hello LuckyLoser, I have not worked with that Petition and have not stamped also. Petition is still valid hence want to know whether i could apply cap exempt with that petition.
