Ruskin Posted October 18, 2016 Report Posted October 18, 2016 I had a H1B petition approved on 2004 June and with that I entered US first time on 2004 December. I used that H1B visa till 2007 March. After that I have never used that H1B visa. My question is if I want to reinstate that H1B petition, is it possible to do now ? If yes, what is the process to do so? Please advice.
JoeF Posted October 18, 2016 Report Posted October 18, 2016 A new employer can file a cap-exempt H1 petition for you, if it hasn't been six years since you last were in the US on H1.

JoeF Posted October 19, 2016 Report Posted October 19, 2016 There is no such thing as "reinstatement" for an H1. An employer always files (and pays for) a new H1 petition.
pontevecchio Posted October 19, 2016 Report Posted October 19, 2016 There is no time period specified in terms of when and for how long a cap subject H1 petition can have the remainder option utilized. The process is to find a H1 sponsor to file and get a H1 petition non cap approved for you. Since it is bound to be profitable to you by all means discuss the situation with facts with the firm of Murthy.
