N C Posted October 18, 2016 Report Posted October 18, 2016 Hi,I was on H4 dependent visa then moved to H1B visa and worked for few months and unfortunately got laid off last week as my employer is closing the company due to unforeseen circumstances. I am planning to travel to India next week and apply for fresh H4 visa and go for counslate interview to get H4 stamping asap . I have two question:1) Do I need to carry documents of my H1B visa (I-797, pay stubs etc) for consulate interview as I am planning to move from H1 to H4? Or H4 application will be viewed independent of my H1B?2) Assuming I get fresh H4 stamped and come back to US and find a new employer down the line, will my new employer be able to apply for H1B transfer despite the current employer notifying USCIS about my termination and applying for H1B withdrawal now?Your response is highly appreciated.
