rtp Posted October 12, 2016 Report Posted October 12, 2016 Hi, I am about to complete my 6th year H1B roughly in about a month. My wife's F1 OPT(working part time) is about to expire in about 10 days. I was initially planning on applying for H1B renewal and COS from F1->H4 and H4EAD at the same time. Things got dragged on by employer and the law firm. I know this is tight now. My employer and law firm are willing to do premium processing but the timing for COS is impossible. I think I have two options now or may be not. Any advice is appreciated. 1) Apply for COS from F1-> H4 immediately on my current H1b which is about to expire in a month. Wait for my H1B renewal packet ready and apply again for COS from F1->H4 again and do a H4 EAD together. I am not sure if I can file COS twice or do I need to file twice. 2) Apply for COS from F1-> H4 immediately. Wait for my H1B to be approved. Apply for H4 extension after the initial COS to H4 comes through( my current H1 will expire by the time she obtains her COS to H4 approved). Apply for H4 extension based on my new H1B. Apply for H4 EAD. Is this an option for us? 3) Any better options? Thanks in advance!
