Karthi1234 Posted October 9, 2016 Report Share Posted October 9, 2016 Hi, I had a H1B petition dated from 10/01/2010 to 06/01/2012. Using this I got a H1b Visa. The expire date in the visa was Jun/2012. Using this I worked for a company for approx one year. I left US Dec/2011 for family reason. Then in 2015 I decided to do a masters degree. I got a F1 Visa and came to US on May/2015. My expired H1B visa is marked as CWOP. I am completing my studies in Mar2017. Whether I can get the old H1b through new employer. I have the old petition with me. Is my Is my H1B valid? Is old H1B valid for "Cap exemption". What is the status of my old H1B, I worked only one year on that. pontevecchio Posted October 10, 2016 Report Share Posted October 10, 2016 You cannot get the old H1 . What you are entitled to is the remainder of 5 years in H1 status with any employer. Each employer who wants to hire you needs to file a non cap H1 petition for you and this includes the previous employer and no term of H1 is more than 3 years at a time. Link to comment
