saswaj Posted October 8, 2016 Report Posted October 8, 2016 Hi I have a situation and need your help in clarifying my queries. I have completed 5 years of H1-B in USA with GC Status in progress my with my current employer (PERM & I-140 Approved). But unfortunately he is not sharing the needful information with related to same. Now, I got an opportunity with another employer and they would like to start H1-B transfer. Since I do not have any GC support documents information with me, 1) Does this effect my H1-B transfer to be approved for 1 year only by considering H1-B 6 year limit? If that is the case, my new employer may take time to file my GC in next 6 months - 1 year time frame by porting the existing I-140 approval, so by that time I am very close my H1-B stay of 6 years. So, is there any points that I need to consider here or are there any other options that can be advised from your end which can be used for my reference. 2) Can I file FIOA (G-639) to request my GC PERM Labor Approval Notice as well I-140 Approval Notice? In general, how much time it will take to have the requested information sent to us by USCIS based on your experiences. And also 3) I am interested in filing H4-EAD, is it good to apply for H4-EAD in this scenario? But at the same time H4-EAD need my I-140 approval information which I doesn't have. 4) How much time it is taking H4-EAD to be approved? Please advise.
