    H4-EAD Renewal

    Does anyone know if H4-EAD can work when the application status is in pending or is there an option to update the application to premium processing? I wanted to know if the validity has been changed due to COVID situation. My current H4-EAD is valid until Dec 23rd and I applied for renewal on June 29th. Thanks in advance.

    H1b transfer during bankruptcy

    I recently got laid off due to COVID from an employer A and currently on 60 day grace period which started on April 3rd. I got an offer letter from employer B who agreed to sponsor for H1b visa immediately. Employer B declared bankruptcy under chapter 11 and stated that they are restructuring but are not expecting to liquidate. Can employer B still file for H1b under these circumstances and if they do will there be any possibilities for visa rejection. Please clarify

    H4 - F1, stamping in India

    I need some information. I have applied for COS from H4 to F1 in december. My change of status is approved. This is my second semester and now I am planning to go to india in the middle of semester due to some personal reasons. I need to get my F1 visa stamped in India. My question is, if I go to F1 stamping in India, what type of financial documents do I have to provide during interview? My husband is sponsoring the fees and all. Can I show his bank statements and pay stubs? Or do I have to show the property documents etc in India. Please help!! Thanks!!

    H1 to F1

    I will be completing 6 years on H1-b visa by Nov-2012 (including vacation time). I didn't succeed at PERM process. My qn is can I convert from H1 to F1. If I convert to F1 do I have to go to stamping before joining Grad School. Also I heard working on CPT. When do a person apply for CPT?? Please advice. Thanks!

    @luck2u: Yes. Your employer can file for H1B extension upon I-140 approval. You can re-enter on that H1-b to US without waiting for an year. But you have to get ur H1B stamped before entering US. Hope this helps. Good Luck!!

    Have you captured the time spent out of country? I was told by my lawyer that - One is eligible to apply for one yr H1 extension only if the applied PERM is pending over 365 dys. According to the dates you specified, I assume that you have applied for PERM after entering 6th year. Yes you need to leave the country if the labor doesn't get approved.. But your employer can apply for H1 extension when you are out of country once your labor is approved.

    Travel during H1b transfer?

    I am currently on H1 with Company A and I have an offer with Company B. Company B initiated the transfer process and I have received the receipt for H1B. I gave two weeks notice in company A. I have one week gap to join company B. In the meantime I need to go to India. My question is Can I go to India after leaving company A and before joining company B. Will there be a problem at port of entry?
  9. Right now I am in the 6th year of my H1B. My visa will expire by Oct 1st 2012. I have been with the same company for more than 5 years. But now my employer is not willing to sponsor the GC. I tried to change the job but didn't work out. I heard that no person can stay on H (H1/H4) visa for more than 6 years?? Is that true? If so do I have to go out of country to be back on H4 visa?? Also after I change my visa from H1 to H4 when will I be eligible to apply for H1 again?? I am also considering Master's program. If I get I-20 from an university and get F1 visa stamped in India, will I be eligible to apply for H1 again after completion of my program. Thanks in advance!!
