    Hi Power, Congrats! Happy for you. For me USCIS took only a day. It shouldn't take too long. I don't know how H1B works. If you want to try AOS through EB1/2 then I recommend you contact a lawyer. You'll need to file the I-140 petition first, then depending on which one of EB1/EB2 or NIW you want to apply for you'll submit your I-485 application (green card). It's pretty complicated and I strongly recommend you find a lawyer who knows these procedures. Best of luck!

    Hi Power, Sorry, I haven't been checking in here. You should contact your state representative. Most of them have websites and forms that you can fill in to let them understand what your situation is. How much time do you have on your visa? Are you a student or a scholar? If you are a student you can maybe get on academic training which can give you more time.

    No, I didn't do any of that. I contacted my congressperson but by the time they replied my case was resolved. But you should do this. Contact your state senator and tell them about your case. They can inquire and it can help you. I think it's the basis Power. I'm sure if your case is solid, you'll get it. As far as I can tell, hardship is a little bit different. My basis was persecution and the issue is known at the DOS so probably that's the reason why it was a bit quick.

    Today USCIS approved my application, surprisingly fast. I'll be waiting the approval notice in the mail. This forum has been very helpful for me. I wish you all the best!

    Thank you Power, No I never had "letter of need" in my list. But I think it might be some other documentation related to your waiver basis (hardship). Also you can see that I have "other" which you don't have. Could be the same thing with different names. Hopefully you'll get a favorable recommendation soon as well. Best of luck! I still have to wait for USCIS's final decision. That could take a few weeks too.

    My DOS page doesn't even show that they received my I-612/613. I did contact my representatives to inquire about my case though. I've heard that it helps. We'll see if it does.

    sach85, when did you first see any update on the DOS website? My timeline is USCIS received application: February 21, 2017 DOS received application: No information USCIS requests DOS opinion: November 1, 2017 DOS receives USCIS request: No information Is there something wrong here??

    DOS website for my case says there's no information regarding my case. But the USCIS website says they asked for non-USCIS advisory opinion on 11/01, which is the opinion of DOS. Weird. Probably DOS is backlogged. As you said Power, as far as DOS is concerned they haven't even received my file. In my case DOS is behind, from what I understand waiver applicant in your case USCIS website is behind. Strange. I wish y'all the best, I hope you get the waiver before I do. As long as it's positive, I don't care when.

    On Nov 1, my case was sent to DOS as well. Power, 'm 20 days behind you so far. Is your case based on hardship?

    I talked to my lawyer and he said he had a response from USCIS within weeks of RFE in some cases, however in some other cases it took at least 6 more months. Good luck to everyone!

    In similar situation. I-612 received by USCIS on February 21st. Received a request for evidence (RFE) on September 7th. RFE received by USCIS on September 20th. You'll wait for at least 6 months to hear anything about your case. In my case it was 6 months + 2-3 weeks.
