  1. Hi, My extension was filed by my current employer and I am waiting for the extension to be approved. My visa got expired. Can I now switch jobs and move to another employer ? Will my new employer be able to apply for H1-B transfer without the current extension being approved ? Appreciate your response.

    F1 - H1 Stamping concerns

In general, stamping for full-time employees is not a problem. Most of them who are facing trouble is consultants who are working under EC/EVC model. Regarding your question on potential immigrant, it shouldn't be a problem as I have my friends who traveled to India almost after 4 yrs got their visa approved. The only thing you need to keep in mind is to carry all the required documents with you. ATB
  6. @Raj88: Please make sure you have the client letter with you while attending the interview. Please push your client to provide one and tell them that it is one of the mandatory documents. From what I have seen in there forums or through my friends is it is a bit difficult to get your visa approved without a client letter. In such case (without a client letter), please ask them to provide some kind of letter/email conversation showing that they will not provide client letters. Also, people who do not have client letters, are mostly opting for either Canada/Mexico. But, in India it is very rare case to get approved as if you are a consultant VO's here are concerned more about Employer/Employee relationship and Client letter is the most important letter which shows that they do not have influence in terms of your employment. Please do some more research and move forward. All the Best

221G GREEN CHENNAI - SEPTEMBER / OCT TRACKER

My Case at Chennai Consulate: Visa Interview Date : 01/09/2011 Model : EVC, MS from the US. 221g : Green Slip (Passport returned. VO told me to submit passport along with the docs asked on 221g form) Docs Submitted on: 01/10/2011 Docs asked to be submitted: 1. Client letter, letters from all intermediate vendors. 2. Copy of contract agreement. 3. Petitioner's Income Tax Return for the last two tax years and financial statements. 4. A notarized list of all the petitioner's employees. The list should show all employees' names, their specific job titles, start and end dates, and their individual salaries and immigration status 5. Along with these all the other basic docs like DS-160, I-797, I-129, LCA, Letter to USCIS, Offer letter, employment contract and other supporting docs as filed to U.S.C.I.S. The interview was very smooth. VO asked me very few basic questions like What are doing in US? What do you for your company? Can you show me your pay-checks? Are you working for any client or on an internal project? You are working at which location?. Are there any middle vendors between your company and Client OK, you need to submit us some additional documentation. Please submit the following docs asked in this letter along with your passport whenever you are ready. I told her that I am carrying all the docs requested in that form but she told me to submit them via dropbox.
