  1. My spouse got a medical RFE on pending I-485 whereas I didn't got any RFE on medical though both of ours medicals that we sent past 2 years (validity). I have below questions: Is it advisable to send my medicals along with my spouse requesting for interfile? If so, can we do interfile by ourself or have to go thru employer/attorney only? If we can do interfile ourself, please advise any specific format for covering letter. Thanks in advance!!
  2. I want to understand the consequences when Employer A withdraw I-140 after we move to Employer B based on pending I-485/I-485J (EAD/AP approved).
  3. I applied for I-140/I-485 concurrently in EB3 as a downgrade, got I-140 approval as I have EB2 with PD as March'2014 for which my PD is retrogressed now. Can I add my dependents now to my pending I-485 (EB3) as I haven't applied their I-485s along with my file initially?
  4. @newacct @Leavemessageh1b I believe if we carry child's Birth Certificate/US Passport Copies which shows parent names should be good enough, correct me if I'm wrong or need to carry anything else as the child will be in USA only with one parent and only myself will travel.

  6. I have valid H1B visa and my son is born US Citizen who is minor. I need to travel to India for a short 2 week trip. As there is an exception for travel ban i.e., under the category of "parent to minor US Citizen" I have below questions.. How to apply for NIE (National Interest Exceptions)? Can we apply from USA itself i.e., apply for exception, get it approved and then travel? How soon should we apply from the travel date? Thanks in advance!!
  7. I have I-485 pending since 9 years and on EAD/AP currently with PD became current in April'21 bulletin. I heard that we can send medicals by interfiling, does it mean that we need to send medicals by enclosing a cover letter stating A # and I-485 Receipt # else any other forms I need to enclose with medicals and covering letter? Please advise. Thanks in advance!
  8. Mexican Visa is required if your US visa is expired. But always, getting a Mexican visa is safe and is very simple process, Mexican Embassy/Consulates issue Mexican Tourist Visa for a period of 180 days with multiple entries and cannot attend for conversion visas.

Mexican Visa is not required as long as you have valid US Visa though you're an Indian national/passport holder but US Consulates/Embassy in Mexico is not accepting third country nationals change of status, have to go for extension in same category of visa class. Canada is an option to go for change of status but need Canadian Visitor Visa to go to Canada for attending US Visa in any Consulates/Embassy located in Canada.

I'm on H1B and my spouse is on H4 in USA as of June'2020 i.e., Proclamation issued date, can my wife eligible to attend for her H4 renewal visa in any country by going out of USA, as there is a relaxation for a spouse to attend for visa at US Consulates (India/anywhere) if primary (H1B) person is in USA as of Proclamation issued date?
  11. @kaviTxYou can submit same set of documents (contract between vendor/employer and vendor/client letters) to different employers when filing in cap, that might get your both cases deny. Second one, it would be good if you check with existing employees if you know from that company about how they run business.
  12. I have CPT/I-20 (F1 status) till Aug 22,2020 and got H1B approval effective Oct 1, 2020 from cap this year. Can I apply for B2 to stay in USA for 5 weeks of period and withdraw the B2 COS application in Oct’2020? Will that impact anything when I go for H1B visa at Consulate in future and Port of Entry during my return to USA? Please advise other options if applying and withdrawing B2 COS has risk.     Thanks @User099! Agree to you on H1B person owning a firm, when I took legal consultation I got to know that H4 person can own business even without EAD but cannot work (lack of EAD) i.e., like H1B person investing in some company shares but not working for the same company while H1B is with a different company.

    @User099: I didn't got your point. Is it good to be on my name itself so that even we loose H4-EAD, I can still continue business as passive investor being on H1B?

    My wife is on H4-EAD, planning to start an LLC for a franchise opportunity. Would you recommend to start an LLC by H4-EAD person as H4-EAD is in jeopardy or recommend me to be included in LLC so that if she lost EAD, we can still continue business on my name as a passive investor, being on H1B. Please advise.
