My employer informed me that I can apply for my extension in march and attend the visa stamping with the new I797. my question is that if my employer applies for an extension it would have start date from october and will I be able to attend the interview with my new I 797? Will I be able to attend the interview with a scanned copy of my I797? If my employer applies for a new H1 B this march which will have the start date from october, can I attend the interview with this new I797 or is it possible that I can have the start date from April in my new I797? Please respond me so that I can plan accordingly. I have to go to india for my marraige in may. Thanks. Link to comment
Attorney_11 Posted February 22, 2013 Report Share Posted February 22, 2013 Since the institution of the PIMS system, most US Consulates and Embassys abroad are accepting copies of I-797 approval notices, though it is best practice to have the original with you, whether for the initial or extension of H-1B classification. BTW if my employer applies for my extension in march, can he specify when could be the start date, as my current H1 expires in september and he says that he will apply extension with start date from April 1st....is it poddible????
