Tuba2011
I applied OPT september,2015 got denial letter 5th february 2016. I applied motion reopen on 15th february 2016. Reason for denial was my sevis record show that i was register courses but my transcript show that i was absent that time. actual fact that mentio semester i was in leave (i had a baby) but my DSO didnt update my sevis. DSO wright a letter to USCIS to describe thet i was her fault she mistakenly didnt update my sevis. My question is how much the possibility to accept my case? what is my status during my waiting time? how much time usually taken to decision ? am i illegal now? Quote Link to comment
JoeF
A motion to reopen does not give you any immigration rights. Quote Link to comment
Tuba2011
what should i do now if i want to stay in USA? go back to new school with new i20 and reentry? or wait for the decision after denial motion reopen then go back to school. ? plz help someone Quote Link to comment
JoeF
You can't "just go back to school". Universities have application deadlines. And an F1 requires that you have the intent to go back to your home country at the end of your studies. What happened to that? You will have to leave. Quote Link to comment
GNH
I suggest you wait for the result ... OPT can now be extended for 3 years. Don't waste it. Quote Link to comment
JoeF
I suggest you wait for the result ... OPT can now be extended for 3 years. Don't waste it. Won't work. The OP has 60 days grace period after the denial. That's over by now. So, the OP has to leave the country. Quote Link to comment
GNH
He can wait in the country during the MTR process . Quote Link to comment
JoeF
He can wait in the country during the MTR process .Only if he had some other valid status. An MTR does not provide any rights to stay. Quote Link to comment
Tuba2011
i already apply MTR because in my denial receipt they told me "if u think that is there any supporting document u have then u can file motion". i was a leave when i had a baby bt stupid DSO didn't update my SEVIS, my school report also shows that i was in leave. thats why i filed motion. bt my concern is am I illegal right now?
