findithereall
Hello, My dad works in HAL and when he applied for visa (B1/B2) last year, was issued a 221g. After that, he was issued a 1 year visa which expires in May this year. He came to US in Feb, and was given a 6 month stay till Aug on his I-94. Will he be fine staying beyond his visa expiration date (may), but leaving before his I-94 expiration? He plans to leave in July. Also, will this be seen as any red flag for his future visa application. I am more concerned about this future visa procedures. Link to comment
rahul412
Yes that's fine as long as his I94 is valid. VISA is required only at POE. Link to comment
ashuneel
You can go to CBP office at the airport( POE) and validate the I-94. If they have made a mistake they can guide you further. Link to comment
JoeF
The visa is an entry document. While in the US, the date on the I-94 is what matters. In fact, a person can enter on the last day of B2 visa validity (actually, by law, the visa has to be valid when the person boards the plane to the US, so it could be expired when the person is at the POE) and the person will still get the full 6 months of allowed stay on the I-94.
