Can you have two simultaneous I-140 petitions (EB2 and EB3) with the same employer?

In case of Chinese citizen, can a person have two simultaneous I-140 petitions (EB2 and EB3) with the same employer? At a later date, can then the person choose to use the petition in which ever category the dates are current? Do both petitions remain valid?

I don't think so for the same job role you cannot...

 

But However if you qualify for multiple positions then you can.. (this will rarely happen)
