Guest
Hello I am on H1B and I have visa stamped on my passport till June 20, 2016. I also have approved I-140 and got my H1B extension approved, so I will have new I-797 hopefully for 3 yrs till June 2019. I will travel to India in April 2016 and will enter US end of April 2016. Is it fine as I have visa only till June 20? Am I supposed to go for stamping? I will carry new 797 etc though.Thank you Link to comment
prabhuitech
you can come back with your old visa and when you come back you need to show both I797 in the port of entry. Only thing is make sure you prepare for the question what if they ask why you didn't go for stamping. Link to comment
pontevecchio
You are allowed to enter anytime within the validity of a H1 visa. What is the reason for concern? Link to comment
rohang
no need to go for stamping. Do carry new I797 with you, they will surely check that at POE. Link to comment
