nsharma2 Posted January 15, 2016 Report Share Posted January 15, 2016 Hello sir, I m stuck in a very weird situation....need your guidance..I was in h4 visa and got my H1B approved on Oct 28th,2015 . Since I couldn't start my job due to personal reasons, my employer revoked it on Jan 8,2016...Does it means that I m out of status now? Please guide me what should I do to get back on my H4 status ? jairichi Posted January 15, 2016 Report Share Posted January 15, 2016 Was your H1B approved as COS i.e. did the I797 come with an I94? If yes, then you had 2 months from the date of approval to report to employer. You are out of status from Dec 29th 2015. A COS is not possible and you need to exit and enter US with a valid H4 visa and a copy of your spouse's I797. Link to comment

I was on h1b I am planning to re-enter US on my preivious h4 to correct my status.I heard if we travel to mexico by land we get a paper i-94. Can you please help:- 1. What all documents i need to re-enter on h4? 2. Do i need to travel by air only? 3. Do we neeed to update i-94 after i re-enter or will it be done automatically as its paper? 4. planning to go to mexico for 1-2 days. is it ok? p.s. You can just cross the border and return in 5 mins. Link to comment

There are instances where H1B beneficiaries have returned to US with a H1B amendment petition pending. You can see some posts in this forum related to that. If at POE immigration officer decides to scrutinize your H1B documents thoroughly you risk being denied entry on H1B. However to enter on H4 you need a valid H4 visa and a copy of your spouse's I797.
