I then came to know that my H1 application had successfully came through the lottery but has gone to the RFE. But the problem is that it is still in RFE (JAN 2016) and my 2nd semester is going to start this week. I don't want to register for classes as i'll have to end up paying the fees. The advisors at my university said that if i drop out from the university i'll be given 15 to 20 days of time to get back to INDIA. In case my RFE gets through within that time, i can update my status from F1 to H1. I have the following questions : -> Can i stay without registering for my classes nor drop out from the university and still stay inside the country inorder for my RFE to get through and have my application approved?? ( since i am inside the country physically ) -> Do i have to maintain an F1 status for sure inorder to wait for my RFE to get through and have my application approved?? I kindly request someone to help me out here!! (ASAP) Link to comment
jairichi Posted January 11, 2016 Report Share Posted January 11, 2016 1. You can apply for a COS to B2 to stay in US and once H1B is approved withdraw COS to B2 petition. 2. Refer 1. Also, upgrade your H1B petition to PP to get a decision in 15 calendar days. Link to comment
