Lost job on H1

Hi

 

I lost my job last and I got a new job within two weeks. My new employer is filing for my H1 transfer. My H1 with previous employer is valid till 2018 and visa is valid till 2016. I am planning to travel to Costa Rica once my H1 processing starts. Will it be fine if I re-enter the country on new H1 receipt or is it necessary for me to wait till I get the receipt and then only leave the country?

You need a valid H1B visa and I797 to enter US.

You could only return once the new H1 is approved.

Its Good to travel outside of US after your H1 transfer approval

I dont think its recommended to travel outside country while your H1 is in process. You can travel but i think your current I94 will no more be valid once you leave. 

 

Check with your attorney to make sure though.
