Can I sue for lying about premium processing?

Hi forum members,


I accepted a job offer a couple of months before on H-1B. During negotiations, they assured me premium processing. Now, when they are filing the petition, they claim that their funding situation has changed and can only do regular processing. Can I sue them? I rejected a lot of offers to take up this one and a lot of time was wasted during which I could have applied to other places. However there is no signed document establishing my accepting the offer conditional on premium processing, only email exchanges. Please help!

No, you can't sue them. Things change in business. Get over it. If you don't like it, find another employer.

As suggested multiple time, you shouldn't resign till next H1b is completely approve. Let them file in regular processing and wait for months for approval. Meanwhile find a better employer and tell the other employer that "things have been changed meanwhile".
