Information required on Visa Stamping in Merida, Mexico

Hi,

 

I am trying to find out if me and my wife can go to Merida, Mexico for our respective H1b visa stampings.

 

Here is some background information.

About Me:

  • Profession: Software Engineer
  • Education: Bachelors and masters from India.
  • 8th year of H1b visa
  • Have I-140 from previous employer
  • Last stamping in Jan 2014 in Vancouver, BC, Canada for Previous employer. 
  • India visit in Feb 2014
  • Changed employer and took up a full-time position in July 2014. 
  • Old employer's Visa expired in Sept 2014
  • Current employer's I-797 valid until mid 2017

About my wife:

  • Profession: Physician
  • 8th year of H1b visa
  • Has I-140 with current employer and is a full-time employee.
  • India visit in Feb 2014 and got her visa stamping done (for the same employer).
  • Visa expired in June 2014
  • Current I-797 valid until mid 2017

The US Consulate of Merida states in the "Who can Apply?" section that :

  1. Third Country Nationals* residing in the United States may apply to renew a visa in any category except B1/B2 or H2.  NOTE – The applicant must apply to renew in the same visa category and cannot apply in a different category.

We both were never out of status. 

  1. I came across another link which vaguely says that the previous stamping needs to be in home country. So, I am kind of concerned and trying to find out if I am eligible to go to Merida, MEX. As my previous stamping was in Canada (And for a different employer).

I was in the same dilemma...got my h1b visa stamped in vancouver and later after a year I was planning to get my visa stamped in TIjuana, mexico and emailed US consulate @tijuana regarding  the same..They responded within a day saying I am eligible to apply for visa stamping..I would recommend you to email them and get a official confirmation.
