H1B Revocation - New H1B cap exempt?

Hi,

 

I had my H1b Petition approved in October 2014 and later went for visa stamping. However it went into administrative processing and I signed withdrawal form. Later I came to USA on H4. A new reputed employer with a reputed client has filed H1b again but it got denied stating that detailed experience letters were not sent. My employer suggests to file a new petition rather than opening MTR.

 

Since I signed withdrawal form,1st petition gets revoked by USCIS and as I never was on H1B status nor had visa stamping, can the employer file Cap Exempt petition now?

 

Please advise. Its Urgent
