I sent in an application for COS to USCIS on June 8, 2015. I just got a receipt but no update as of now. So my question is once my H1 comes to an end in September on the date printed on my H1, will I be out of status or not to worry since I already sent in my COS I-539 to USCIS ? Attorney_21 Posted July 23, 2015 Report Share Posted July 23, 2015 You are in a "period of authorized stay" as long as your change-of-status application is FILED before the expiration of your current status, so you are allowed to remain in the United States until USCIS makes a decision on your case. (You are not allowed to work after the expiration of your H1B, however). Link to comment
