Work From Home on H1B

Hello All,

 

Is it not legal to work from home when on H1B visa? I am planning to go for visa stamping in Vancouver, CA. What supporting documents can i show to prove that i work remotely for my client?

The LCA has to specify the work location, which in this case would be your home address.

Your home is your work location so it has to be included in the LCA. If it is not in the same MSA as work location mentioned on LCA, a petition amendment has to be filed.

Yes, you can work from home if LCA and H1B is filed accordingly. Documents are standard similar to H1B stamping.

I think its usual for employees to work from home occasionally in that case if the employee home address falls within the same MSA as the actual office address, would the LCA also needs to mention the home address along with the office address or if the office address is mentioned and home is within the same MSA its automatically covered?

Performing work from home occasionally is acceptable and does not need an amendment. But, if the work is done mainly from home then an amendment is needed. Looks like OP is not doing occasional work.
