If I get my EB2 I-140 copy from my Previous employer, Can I apply I-485 individually with help of a law forum, without any involvement of previous employer ? Please let me know. Attorney_15 Posted June 29, 2015 Report Share Posted June 29, 2015 One can only file an I-485 based on an I-140 if there is a valid job offer from that I-140 petitioner. This is proven to USCIS at the I-485 stage by a letter verifying their intent to employ the I-485 applicant on approval of the I-485. And if that I-485 is approved in less than 180 days, then the I-485 applicant is expected by law and USCIS to work in the I-140 job for a reasonable period of time following approval of the I-485.
