baidurja Posted June 18, 2015 Report Share Posted June 18, 2015 Hello, My employer is filing my EB2-PERM application, and I am currently eligible for EB2-NIW (but not yet for EB1-B according to the lawyers). Assuming EB2-NIW and PERM I140s get approved, what can be the advantages of filing the NIW ? From what I understand, the only advantage may be that if I change jobs, my new employer does not have to file another PERM application. Thank you. Link to comment

Your work would have to be in the national interest of the US (that''s what NIW means, National Interest Waiver.) That means your work would have to be important research or development on the level of the Linux OS (Linus Torvalds, the main guy behind Linux, got his GC through NIW.) Is your work on that level?
