My current employer BB is applying L1B visa for me, which means I will be in the US even before H1B gets approved in october. While in the US with BB on L1, can I get the H1B filed by AA transferred to BB? Note that in this case I wouldn't serve a single day for AA on H1B. Thanks in advance. Link to comment

aa11 Posted May 27, 2015 Author Report Share Posted May 27, 2015 I understand that if employer AA withdraws the petition before october 1st for some reason, employer BB cannot file a cap exempt petition. Can employer AA withdraw the petition after Oct 1st? If no, is there any I can lose my lottery after oct 1st? Link to comment

If you do not join employer AA after Oct 1st then by law your H1B petition has to be revoked. It will not affect your cap exempt H1B petition filed by future employer. Link to comment
