H1B Rejected and case sent to USCIS for review

I had interview with Delhi embassy. After 2.5 months got this reply from USCIS. Never heard from embassy about it.

What are my options now ?

Can my employer file for new H1B while review is in process or do we've to wait till USCIS finish their review ?

My lawyer said we've to wait until we get NOIR ( Notice of Intention to Revoke). I am not a lawyer but in my opinion a new visa should be applied because this petition will expire on Sept 30'th this year which is few weeks from now.

My employer is ready to file a new H1B. Guys please let me know. Its agains me and my company lawyer!!! My HR don't understand much about immigration and our immigration is all in the hands of lawyer.

Instead of waiting for NOIR, better to file new H1. My case has been pending since 11 months.

Who is your employer. Can he file for me?
