Investor in Failed EB-5 Investment

An individual invested in in a project under the EB-5 program.  The investment was never started.  Conditional green card expires in July, 2015.  Investor will not file I-829 on original investment.  Investor filed a second I-526 on a new investment.  Investor's son is in the US and wants to apply for an F-1 visa while second I-526 is being processed.  I don't know how that is possible.  How can one go from an immigrant status to non-immigrant status without leaving the US? Thanks for any assistance.  Ed

With the amount of money you need to have for an EB5, you can afford to schedule an appointment with a lawyer.

Don't try to be penny-wise and pound-foolish.

EB5 is a complicated thing.
