H4 EAD for spouse on H1B

Hi

I am on H1B(I-140 approved) and my spouse is also on H1B

If I plan to apply for H4 EAD for my spouse, she needs to get converted to H4 first and then apply for EAD

If I am not wrong, this whole H1B to H4 to H4 EAD might take few months

During this time, is there a way she can continue her job (since on H4 you cannot work)

 

Is there any workaround for this situation?

Till she gets her COS to H4 approved she can continue working. Once she gets her EAD she can start working again.

She can work until the H4 is approved.

She then has to stop working, and can only start working again once the EAD is approved.

I think there is no way to fill the gap.

This is really a tricky thing that if the process takes 3 month, one has to be jobless since no company would give that lengthy vacation

Then its better to continue on H1 and when you feel that time right then go for H4 and EAD.

She can continue on the H1.

The H4-EAD is basically designed for people who are in H4 status already.
