AT THE PORT OF ENTRY IN USA, I RECEIVED A TRUNCATED I-94 UNTIL OCTOBER 2013 (PASSPORT EXPIRATION DATE). MY COMPANY WAS NOT AWARE OF THIS TRUNCATED I-94 & FILED FOR A H1B PETITION RENEWAL w/ NUNC-PRO-TUNC TO PARDON THE OVERSTAY ON OCTOBER 2014. THIS H1 RENEWAL PETITION (VALID UNTIL AUGUST 4TH 2016) WAS ACCEPTED BY USCIS ON FEB 2015, BUT THE NUNC-PRO-TUNC PETITION WAD DENIED. My lawyers are suggesting that I depart to India and apply for the I-194 nonimmigrant waiver. Do we know what the current processing timelines are the non-immigrant waiver ? Link to comment
