snayani8541 Posted February 10, 2015 Report Share Posted February 10, 2015 Hi all, My husband has his I-140 approved in EB3 before our wedding. I am also on H1. He is wanting to port to EB2. My question is can he file for I-485 now or does he have to wait till he ports to EB2 to file I-485 ? Will that make any difference with respect to EAD processing time ? Please suggest. ashuneel Posted February 23, 2015 Report Share Posted February 23, 2015 He can file I-485 only when the date is current for his country of chargebility. He has to find an employer who will file new PERM and I-140 under EB2 to port the date. Link to comment
