What I want to know is while working on a work permit in USA, if my brother a US citizen applies for family based GC, can I extend my work permit based on the application? I have 15+ years of experience and have B. Tech. from India. Will I be eligible for EB2? thanks Sandy Link to comment

JoeF Posted February 5, 2015 Report Share Posted February 5, 2015 An H1 can NOT be extended past the 6 years based on a family-based GC application. It is only possible based on an employment-based GC application. And the employment-based GC category depends on the job requirements. You could have a PhD, if the job only requires a bachelor degree, the case would still be in EB3. Link to comment
