can I extend H1B work permit based on Family based GC application process

Hi

 

I was born in India, acquired Canadian citizenship a couple of years ago and now want to move to the USA and settle down finally. 

 

What I want to know is while working on a work permit in USA, if my brother a US citizen applies for family based GC, can I extend my work permit based on the application?

 

I have 15+ years of experience and have B. Tech. from India. Will I be eligible for EB2?

No, You cannot . Consider the H1/L1 or TN route and then get a GC sponsored.

Employment based applications and family based applications are two different routes. Based on family based application for GC you cannot extend work permit.

An H1 can NOT be extended past the 6 years based on a family-based GC application.

It is only possible based on an employment-based GC application.

 

And the employment-based GC category depends on the job requirements. You could have a PhD, if the job only requires a bachelor degree, the case would still be in EB3.
