DS160 : Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?

Hi there,

 

 I'm filling my DS160 and have this question that flagged me. My employer has filed PERM but it got query and the response was sent. The status is yet to know. So, what should be my response in the form for the following question ? Should I say No or Yes??

 

Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?

Answer is NO.

The I-140 is the immigrant petition. If that hasn't been filed yet, then the answer to that question is no.

Answer is NO.  

 

You should answer YES only when the I-140 has been filed.  I-140 is the immigrant petition.  PERM is just a procedure to follow prior to filing the immigrant petition.
