Canada visa stamping from US

Hi all,

 

I am currently on US in L1B visa (Indian passport holder) but my visa is expired and I797 also expired. But I have one year valid I94 which I got when I entered US. Do I can apply Canada intra company transfer work permit from US? Do I need a valid visa to apply from US?

When your I797 has expired your I94 is no good. You can not even stay in US. Talk to your employer's attorney immediately.

I am confused now. I was told that visa was only to enter US then we can stay till the date mentioned in I94. So while in enetered US I got I94 date more than my visa expiry date.

 

Are you telling I can stay in my I94?

If petition is no longer valid i.e I797 expired then I94 has no meaning here.

Are you covered by a blanket L1? In any case you should refer to a Canadian site for information about Canadian work permits.

Yes I am having Blanket L1. I cross checked with my employer, I can stay US as long as my I94 is valid.

 

But my question is Do I can apply Canada work permit from US consulate using this I94?

 

I checked Canadian site and they are asking for I797. But my I797 doesn't have any dates, it is a blanket petition valid only for my employer.

A blanket petition allows you to stay based on I94.

Yes, you can apply for Canada work permit. Get an attorney involved.
