Apk001 Posted August 5, 2014 Report Share Posted August 5, 2014 Hello, I am currently living in US in H4 visa, I have applied for H1b from India 6 months back which was under administrative processing is currently approved. My question is, do I need to go back to India and get it stamped from embassy? If No, How can I get it stamped from USA? I do appreciate if anyone can help me as soon as possible. jairichi Posted August 5, 2014 Report Share Posted August 5, 2014 A visa is stamped in a consulate. A US consulate does not exist in US. You need to exit US and have your visa stamped. Link to comment

My wife was in a similar situation ... her F1 visa was in admin processing in toronto while she was in USA ... we emailed the consulate and asked them if she has to be physically present and here is their reply - If you wish to obtain your F-1 visa at this Consulate, you will need to be physically present in Canada, you cannot be granted a visa while you are still in the U. S. The visa will be affixed to your passport for presentation to a DHS officer at the border who will admit you in F-1 status. Link to comment

Better option will be COS if employer is willing to pay H1B fee again. Link to comment
