Change status to H1b from H4

Hello,

I am currently living in US in H4 visa, I have applied for H1b from India 6 months back which was under administrative processing is currently approved.

 

My question is, do I need to go back to India and get it stamped from embassy?

If No, How can I get it stamped from USA?

 

I do appreciate if anyone can help me as soon as possible.

yes i think you would have to go to india. My wife was in a similar situation ... her F1 visa was in admin processing in toronto while she was in USA ...  we emailed the consulate and asked them if she has to be physically present and here is their reply - If you wish to obtain your F-1 visa at this Consulate, you will need to be physically present in Canada, you cannot be granted a visa while you are still in the U. S.  The visa will be affixed to your passport for presentation to a DHS officer at the border who will admit you in F-1 status.

Thank you for the response.

 

I heard about "Change of Status" , Am I eligible for that? Is that work in my condition?

If so, how long it will take?  Which one will be the better option?

3 to 4 months by regular processing and 15 calendar days by premium processing. Better option will be COS if employer is willing to pay H1B fee again.
