sunny4876
Hi All, i hold an valid H1b visa till 2016 for an Employer A and now i got an onsite offer from Employer B, they are ready to transfer my visa I have few queries on the same 1. Do i need to go for Visa Stamping again? 2. Do i need to submit fresh documention again or USCIS will consider my earlier petetion documentation? 3. As many reviews were saying i can travel with my existing visa and new I-797 of employer B, is this Correct? 4. What will be the questions at POE? How should i convince them? 5. Are there any chances of transfer denial? Note: I didnt travel to US atleast once. Thanks in advance, Sunny. Link to comment
jairichi
1. No. 2. Cap exempt H1B petition has to be filed by employer B. So, you will need to provide documents. 3. Yes. 4. Any question related to you, employer and job. Truth will be your answer to convince them. 5. No one can predict that. Link to comment

jairichi
1. The date USCIS generates a receipt notice. 2. Yes, calendar days that includes Saturday and Sunday. 3. Within a week to two. 4. Based on I129 and USCIS discretion. Yes, you can travel with existing valid H1B visa and new employer's I797. Link to comment

owvi
I am in similar situation like sunny4876. I wrote an email to US consulate to check whether we can travel using old visa stamp with new I797. Below is their reply. I'm really confused whether I need to go for stamping again. Thank you for writing to the U.S. Visa Service Desk. We understand that you have a query regarding your valid H1b visa. In response to your question we would like to inform that, since you have changed your employer, you will not be able to travel with your old H1b visa, you need to apply for new visa. Please follow the link:http://www.ustraveldocs.com/in/in-niv-typework.asp#apply for the detailed information regarding H1b visa application procedure. We hope this information is helpful to you.
