Need advice on H1b Transfer while in india

Hi All,

 

i hold an valid H1b visa till 2016 for an Employer A and now i got an onsite offer from Employer B, they are ready to transfer my visa

 

I have few queries on the same

 

1. Do i need to go for Visa Stamping again?

 

2. Do i need to submit fresh documention again or USCIS will consider my earlier petetion documentation?

 

3. As many reviews were saying i can travel with my existing visa and new I-797 of employer B, is this Correct?

 

4. What will be the questions at POE? How should i convince them?

 

5. Are there any chances of transfer denial?

 

Note: I didnt travel to US atleast once.

Hi All,

 

My case progress further....

 

 

Now my company B had started processing my Visa Transfer by Premium Processing. I already submiited all required docs and even they provided the client letter(reputed).

 

Not sure on the filling date, will let you once i know.

 

 

here are my queries

 

1. As said in many reviews, it will take 15 days. Could you tell me from which day it starts counting?.

 

2. 15 days means including saturday and sunday or business days?

 

3. Once approved, i can travel only once i recieve my New I797 hard copy. How much time it will take to get by hand.

 

4. This is regarding my new I797 petetion period.

 

my current I797 & Visa stamp are valid for Three years till sept 2016 and now my question is...

 

already one year passed, now i am new I797 will be approved for remaining period or ?

 

Final Question:

 

Sorry guys asking the same question again.

 

Pls confirm that i can travel with old company visa stamp and new I797 petetion. At POE, i need explain them the actual scenario right?

Hi All

 

Just wanted to update my case status...as said above, i got my approval for transfer(new) petition applied by employer B in a span of 5 days.

 

Waiting for the hard copy and once got it, all set to Go :)

 

As said by Jairichi we can travel with existing valid visa stamp and new i 797 approval notice, even the same is confirmed by employer.

finally i landed in US with Old visa stamp and new petition. At POE(NY) there were questions like

 

Is this your first time to US?

You had never used you visa by seeing the visa stamp.

 

Finally stamped with 2 years till last date of my passport expiry.

finally i landed in US with Old visa stamp and new petition. At POE(NY) there were questions like

 

Is this your first time to US?

You had never used you visa by seeing the visa stamp.

I am in similar situation like sunny4876. I wrote an email to US consulate to check whether we can travel using old visa stamp with new I797. Below is their reply. I'm really confused whether I need to go for stamping again.

We understand that you have a query regarding your valid H1b visa. 

In response to your question we would like to inform that,since you have changed your employer,you will not be able to travel with your old H1b visa, you need to apply for new visa.
